UK Court Grants Residency After Refugee Wins Legal Battle

A refugee who entered the United Kingdom on a Pakistani passport has won the right to remain after a successful legal appeal. He argued that he is an Afghan national and faces serious risks if returned, including threats from the Taliban and harm to his family life.

Court Recognises Legal and Security Risks

The refugee based his appeal on Article 8 of the European Convention on Human Rights, which protects the right to family life. An immigration tribunal initially rejected his claim. However, a higher court overturned the decision after identifying legal errors. Judges noted that Afghan law does not allow dual nationality and that the Taliban target Afghans who previously fled to Pakistan.

Best Interests of Children Take Priority

The court also rejected the idea that the children’s welfare could be equally protected in any country. Judges ruled that it was unreasonable to assume their best interests would be met in the UK, Pakistan, Kuwait, or Afghanistan without proper consideration. The ruling strengthens protections for refugees facing complex nationality and security risks.
